Alabama follows community property laws, meaning most assets acquired during marriage must be divided fairly. We assist clients in Tuscaloosa with:
✔ Dividing real estate, military benefits, and retirement accounts
✔ Ensuring fair debt allocation
✔ Negotiating settlements that protect your financial future
Spousal support, or alimony, is not automatic in Alabama but may be awarded based on:
✔ Length of the marriage
✔ Each spouse’s financial needs and earning capacity
✔ Contributions made during the marriage
Under the Uniformed Services Former Spouses' Protection Act (USFSPA), outlined in 10 U.S.C. § 1408, the 10/10 rule determines whether a former spouse can receive direct retirement payments from the Defense Finance and Accounting Service (DFAS). This rule applies if:
✔ The marriage lasted at least 10 years
✔ Those 10 years overlapped with at least 10 years of military service
If these conditions are met, DFAS will send a portion of the service member’s retirement pay directly to the former spouse. If not, DFAS will not get involved, and the full retirement payment will go to the military member.
Former military spouses may also be eligible for continued benefits, such as Tricare health coverage, under the 20/20/20 rule. This requires:
✔ 20 years of marriage
✔ 20 years of military service
✔ 20 years of overlap between the marriage and the service
If all three conditions are met, the former spouse may retain full military benefits even after divorce.
Child custody disputes can be especially complicated for military families. Alabama courts prioritize the best interests of the child, and we work to:
✔ Establish joint or sole custody arrangements
✔ Develop customized parenting plans
✔ Protect parental rights while ensuring a stable home for the child
For service members: We assist with custody modifications for deployments and relocation issues.
Alabama courts often impose geographic restrictions on where a child can live after divorce. If you need to relocate outside of Tuscaloosa County and surrounding counties, you may need to request a modification of your custody order.
We assist clients with:
✔ Filing relocation requests
✔ Challenging or enforcing geographic restrictions
✔ Protecting parental rights when relocation is involved
Whenever possible, we encourage peaceful and cooperative divorce solutions that reduce stress and protect families.
Beyond divorce, we offer comprehensive family law services to help individuals and families protect their rights and plan for the future.
✔ Prenuptial & Postnuptial Agreements – Protecting financial security before or during marriage.
✔ Adoption Services – Helping families complete the legal adoption process.
✔ Contempt & Modification of Court Orders – Assisting with child support, custody, and visitation modifications.
✔ Termination of Income Withholding Orders - Assisting clients with the termination of court-ordered withholding when the minor child reaches age 19.
